Definitions

M4Reactor – The M4Reactor is a program of the Make Delmarva Foundation, Inc (herein MDF), a non-profit 501(c)(3).

Affiliates - Anyone associated with M4Reactor or MDF, including, but not limited to: officers, agents, employees, volunteers, board members, other makers, guests, sponsors, licensees, and assigns.

M4 Products and Services - The facilities, tools, materials, designs, and/or instruction provided by M4Reactor and MDF

Visitor/Guest - The below signed individual (Guest or Visitor), including the parent or legal guardian, if applicable.

Visiting - The act of physically being in the M4Reactor/MDF space.

Assumption of Risk to Maker

Visitor/Guest acknowledges the inherent risks in Visiting. Risks include, but are not limited to: cuts, abrasions, sprains, strains, burns, lacerations, fractures, amputations, loss of vision, loss of hearing, illness, disease, or death. Possible causes of such risks include, but are not limited to: slips, trips, falls, fire, electrocution, hot surfaces, sharp surfaces, slippery surfaces, chemicals, carcinogens, smoke, irritants, loud noises, blunt force trauma, or explosions. Visitor/Guest acknowledges that such risks may arise from Maker, other makers, guests, M4Reactor staff or volunteers, or any other person/entity, and that causes of risk may be foreseeable or unforeseeable. Visitor/Guest hereby fully assumes all such risks and any others which arise because of Visitor/Guest’s association with M4Reactor.

Medical Attention

Visitor/Guest hereby gives permission to M4Reactor and its Affiliates to provide and/or arrange for emergency treatment and/or transportation in the event of an injury or illness. Visitor/Guest hereby accepts full responsibility for the payment of any costs incurred from such treatment or transportation. Visitor/Guest acknowledges that the Release of Liability and Covenant Not to Sue extend to any damage, loss, injury or illness incurred as a result of such treatment or transportation.

Assumption of Risk to Visitor/Guest’s Property

Visitor/Guest acknowledges that there are risks to any property Visitor/Guest brings to M4Reactor facilities or instruction. These risks include but are not limited to: normal wear and tear, damage, loss, theft or destruction. Visitor/Guest acknowledges that such risks may arise from Visitor/Guest, other makers, guests, M4Reactor staff or volunteers, or any other person/entity, and that causes of risk may be foreseeable or unforeseeable. Visitor/Guest hereby fully assumes all such risks and any others which arise because of Visitor/Guest’s association with M4Reactor.

Release of Liability

Visitor/Guest releases M4Reactor and its Affiliates from any liability whatsoever arising out of any damage, loss, theft, injury, or illness to Visitor/Guest or Visitor/Guest’s property in association with M4 Products and Services and/or the products and services of its Affiliates, regardless of whether such loss or injury is as a result of negligence of M4Reactor or its Affiliates, or is a result of some other cause.

Covenant Not to Sue

Visitor/Guest agrees that Visitor/Guest will not, under any circumstances, initiate any legal action against M4Reactor, MDF or its Affiliates. Furthermore, Visitor/Guest will not assist in the prosecution of any such legal action filed by another, except as required by law. Visitor/Guest desires that this covenant should extend to include the heirs, executors, administrators or assigns of Maker.

Recordings

Visitor/Guest acknowledges that M4Reactor and/or its Affiliates may make audio and/or visual recordings of activities related to M4 Products and Services, which may include Visitor/Guest, Visitor/Guest’s tools, materials, designs and/or creations. Visitor/Guest consents to the making and use of such recordings by M4Reactor and/or its Affiliates for any purpose. Visitor/Guest releases M4Reactor and its Affiliates from and waive any claims related to or arising by reason of the making and/or use of any such recordings. Furthermore, Visitor/Guest grants to M4Reactor the right to use Visitor/Guest’s name and likeness in connection with the use of any such recordings.

Usage of Tools & Equipment

Visitor/Guest agrees that they are only permitted to use equpment and/or tools that a manager or instructor of M4Reactor provide to the visitor/guest to use.

Visitor/Guest hereby acknowledges that Visitor/Guest has carefully read all of the above provisions, fully understands same, and voluntarily signs this document as a condition of using M4Reactor’s Products and Services.
